Hurt At Work: Getting The Compensation You Deserve

Law Blog

If you are injured while working, you have the right to receive workers' compensation benefits in order to keep you financially stable while you recover. Once you file a workers' compensation claim to get benefits, you start the process of holding your employer responsible for your injuries. If there is a third party involved, there could be an opportunity to file a personal injury claim against that third party. A personal injury attorney will be able to go through the specifics of your case and determine if you are entitled to workers' compensation. They can also help you decide if you should file a personal injury claim against another responsible party.

Filing Your Workers' Compensation Claim

While the process of filing a workers' compensation claim should be straightforward, there are many reasons that workers' compensation will deny your claim. Sometimes you will understand why your claim was denied, and other times you may have no idea what was done wrong that would make them deny your claim. A workers' compensation attorney can look through the details of your claim and help you figure out how to get the benefits you deserve.

When Your Injuries are Severe

You will need to get medical treatment as soon as possible. When progress is slow and your injuries are severe, you may have a difficult time returning to work. While your workers' compensation claim will cover a percentage of your overall earnings while you remain unable to work, this is usually a low amount for people to try to live on. An attorney can identify whether there is a third party you can file a personal injury case against in order to get additional compensation.

Strengthening Your Personal Injury Case

As you work with medical providers, follow all treatment recommendations. Don't miss any appointments and always be clear regarding your symptoms. To strengthen your case, write down how you are feeling every day and take notes while you are getting care. When it comes to your overall injuries, the details matter. Take pictures of your injuries and continue to take pictures while you heal. The more information you can provide to your attorney, the easier it will be to negotiate on your behalf.

When you are hurt at work and you are not able to return for some time, you will need to file for workers' compensation benefits. If the injuries leave you permanently disabled, it's time to get the help of a personal injury attorney to protect your financial future.

Noni and the Accident

My name is Noni. When I was in college, I was hit by a car while crossing the street. My life was never in danger, but I did break a few bones and had a lot of huge medical bills. I was hoping I wouldn't have to get involved with an attorney, but unfortunately, it came down to that. I used a family friend who is an accident attorney to get some compensation. A few years later, I was hit while riding my bike and had to go through the same process. I suppose I'm lucky to be alive. And it's thanks to accident attorneys that I have been able to put my life back together. I started this blog as a way to let others know just how much lawyers can help you in certain situations.
