What To Know If There Is A Small Claims Judgement Against You

Law Blog

When a person or business feels that another person owes them money, they have the option to take them to small claims court to fight for a small claims judgement. If the court thinks that the accusing party is correct and that the defendant owes them money, they may enter a small claims judgement against the defendant. If this has happened to you, or if you think it might happen to you sometime soon, then you could be wondering what you should expect and what you should do next. Some of the things that you might want to know if you are in this situation can be found below.

It May Not Be Too Late To Defend Yourself

If you are facing a small claims case but have not been found responsible for the debt yet, then you should know that taking action before a judgement is entered against you is usually the best course of action. You may be able to prove that you aren't actually responsible for the theft, or you might be able to negotiate for a lower amount or get on a payment plan.

There Are Many Types of Small Claims Judgements

If you think you have a small claims judgement against you but aren't sure why, you should know that these judgements are put in place for a number of reasons. You might have a small claims judgement entered against you if you owe credit card debt, owe an old landlord money for past rent or repairs to the rental, and for other reasons.

Your Credit Could Be Affected

Once you have a small claims judgement put out against you, you should know that your credit can be negatively affected. This could impact your ability to take out loans and credit cards, for example.

Your Wages Could Be Garnished

In some states, your wages can be garnished, and a portion from each of your paychecks could be paid to the person or business that you owe money to. Lottery winnings, tax refunds, and more can also be garnished.

If you find out that there is a small claims judgement against you, it's important for you to take the situation seriously. You may want to contact a lawyer for advice as soon as possible. They can tell you a little more about your rights and what you should expect, and they can help you each step of the way.

Noni and the Accident

My name is Noni. When I was in college, I was hit by a car while crossing the street. My life was never in danger, but I did break a few bones and had a lot of huge medical bills. I was hoping I wouldn't have to get involved with an attorney, but unfortunately, it came down to that. I used a family friend who is an accident attorney to get some compensation. A few years later, I was hit while riding my bike and had to go through the same process. I suppose I'm lucky to be alive. And it's thanks to accident attorneys that I have been able to put my life back together. I started this blog as a way to let others know just how much lawyers can help you in certain situations.
