What Common Medical Malpractice Types Can You Sue For? Here Are A Few

Law Blog

Medical malpractice is a difficult and complex area of the law that concerns whether or not a doctor, nurse, or other health care provider neglected their duties causing damage and injury to the patient.

In some cases, any mistakes made by the medical professional weren't recorded by hospital administration staff, making it harder for a personal injury lawyer to prove in court.

If you have been injured during treatment or otherwise by a medical professional and want to sue to receive compensation for any lost wages or pain and suffering, here are just a few common types of medical malpractice you could sue for.

You Were Misdiagnosed

Misdiagnosis of a serious or potentially fatal illness or disease can be a reason for a personal injury lawyer to sue a medical professional. A doctor might have missed some significant signs or didn't use diagnostic equipment that would have found the illness or disease in time for it to be treated effectively.

Your lawyer would need to prove that your doctor was negligent in not using everything at their disposal to get a diagnosis and instead did the bare minimum. This could have resulted in an illness progressing to the point where it is either difficult to treat or untreatable.

If your lawyer can prove that another doctor would have discovered the illness or disease in enough time to treat it properly, then you may have a case to get compensation.

Damage Was Done During Surgery

There have been cases in which patients have been injured due to errors occurring during surgery. While this is most likely unintentional, these injuries can result in serious consequences for the patient including pain and suffering.

Your personal injury lawyer could have a case to sue if your medical professional made errors during surgery such as doing damage to your organs, nerves, or other tissue, doing the wrong procedure or performing it incorrectly, leaving medical instruments inside you, and even doing a surgery that wasn't needed.

If you didn't receive the proper care after your surgery, you may also have grounds to sue. It's important for a patient to be treated correctly otherwise it could result in infection or permanent damage during recovery.

Prescription Drug Errors

It's possible that you were given the wrong prescription to treat your illness or disease, or perhaps you were given a painkiller that you are allergic to. These could be cases for your personal injury lawyer to sue for medical malpractice.

A medical professional including your doctor and even pharmacist should be aware of what your diagnosis is, your overall health, and if the medication they prescribe is adequate or correct for treating that illness. They should be aware of any allergies to the medication you are taking.

If they didn't do their due diligence in providing the best care when prescribing drugs for your condition, you could contact a local personal injury lawyer to sue for medical malpractice.

Noni and the Accident

My name is Noni. When I was in college, I was hit by a car while crossing the street. My life was never in danger, but I did break a few bones and had a lot of huge medical bills. I was hoping I wouldn't have to get involved with an attorney, but unfortunately, it came down to that. I used a family friend who is an accident attorney to get some compensation. A few years later, I was hit while riding my bike and had to go through the same process. I suppose I'm lucky to be alive. And it's thanks to accident attorneys that I have been able to put my life back together. I started this blog as a way to let others know just how much lawyers can help you in certain situations.
